Background Check for Prospective Guardian 623-10-10-15

N.D.C.C. 50-11.3-01 provides that before appointment as a legal guardian under Chapter 27-20, the individual must be subject to an assessment that includes the result of a criminal history record investigation. In all cases, a criminal history record check will include a Bureau of Criminal Investigation (ND BCI) check. It may also include the FBI check, depending on how long the prospective guardian has resided in North Dakota. It is North Dakota Department of Human Service policy that all adults in the prospective guardian’s home must have the background check. CFS pays for the BCI/FBI background checks.
The guardianship background check request must be submitted to CFS on the specific forms related to guardianship. A prior background check for another program will not suffice.
